Sweden Update

Sweden introduced a more powerful law on 1 January this year that enhances the opportunities to report the public activities of unhealthy competition. Previously, only residents of the current municipal register could report to the local district court to see if there was enough substance of unhealthy competition. This meant that a local businessman who threatened to complain might have hesitated in case it created the wrong impression. There was also a lack of knowledge of how to go about complaining of unfair practices. The old law was not clear on what actually constituted “unhealthy competition”, but this is now clarified. Now, organizations and associations are allowed to report all complaints regardless of where in Sweden they happened and it is handled in one place at the Stockholm District Court. FRISK, the Swedish National Association has already started with reporting 3 different municipalities in order to test the new law and to hopefully get a strong precedent.

Later this spring we will run an educational seminar for the fitness industry on this subject so that our colleagues can better understand the importance of bringing an action. Ola Helt, FRISK’s Secretary General said that “This is a big step in the right direction”. http://www.friskorg.se/


Sverige fick en starkare lagstiftning den 1 januari i år som förstärker möjligheterna att anmäla kommunal verksamhet för osund konkurrens. Tidigare kunde endast en invånare i aktuell kommun anmäla vilket medförde dels att man som affärsman riskerade att bråka med sin, kanske största kund, samtidigt som kompetensen saknades. Nu får organisationer anmäla och alla anmälningar oavsett var i Sverige det är hanteras av Stockholms tingsrätt. Vi som nationell branschorganisation kommer att anmäla 3 olika kommuner för att på så sätt prova den nya lagen samt förhoppningsvis få fram ett prejudikat. Senare i vår kommer vi att genomföra en utbildning i branschen i ämnet så att kollegorna bättre kan anmäla och förstår vikten av att få saken prövad i tingsrätten.
